Photography and Use of Images – What You Can and Cannot Do
Where Can You Take Photos?
Whether you can take photos of people depends on whether they are in a public or private area.
- Public Areas: These are places that anyone can access without special permission or payment, such as a shopping street, flea market, or sidewalk. In these areas, you are allowed to take photos without needing consent from individuals, and it is not punishable.
- Private Areas: These include places such as homes, apartments, inside a car, or any other private space. You are not allowed to take photos of people in these areas without their consent. It is important to obtain permission from the person who controls the space before taking any photos. For example, if you are inside someone’s home, you need the consent of the homeowner to take photos.
What Can You Use the Photos For?
- Criminal Code: It is illegal to make private photos or images that are meant to be kept private publicly accessible. If you share such images, you may be committing a criminal offense.
- Social Media: While there have been no definitive rulings, sharing photos on social media could be considered making the images public, which may expose you to legal risks.
General Data Protection Regulation (GDPR)
- The Danish Data Protection Authority distinguishes between two types of images: portrait images and situational images.
- Portrait Image: A photo focusing on a person’s face, where they are the primary subject. Examples include a portrait photo or a class photo. These require the person's consent. If there are multiple people in the photo, you need consent from each individual.
- Situational Image: This is when people are not the primary focus, and the situation is the most important aspect of the image. For example, a photo of someone leaving a store or a group of children playing in a playground. These types of images are not considered personal data and do not require consent.
- The distinction between portrait and situational images is a case-by-case assessment, so the above examples are not exhaustive.
Copyright Law
- Copyright law protects the expression of works, including how an image looks. The photographer is the one who holds the rights to the image.
- If a photographer takes a picture of a copyrighted work and makes it publicly accessible, such as by posting it online, this is considered a violation of copyright.
- If you are a photographer and someone has commissioned a photo session, the photographer cannot make the images publicly available without the subject’s consent, according to Section 60 of the Copyright Act.
- If you are photographing something that is copyrighted, be cautious. If the copyrighted work is prominent in the photo, you may want to reconsider publishing it. Always obtain consent from the photographed person and clarify what the consent covers and how the images may be used.
Marketing Law
- If you take a photo of a person and later use it for commercial purposes, it may violate good marketing practices. Violating this can result in a court order to pay compensation based on the damages incurred, often the loss suffered by the person whose image was used.
Friday bar
The Friday Bar is open on Thursdays and Fridays from 2:00 PM, where alcoholic beverages can be purchased. Non-alcoholic drinks can be purchased on any day outside the cafeteria's regular hours.
